When you order a service from us, you enter into a contract with us. This contract is made up of:
For our directory listings our clients can upload the adverts themselves (Standard and Superduper). Payment will be requested online and can be paid using a credit/debit card using our PayPal secure payment option.
For all other advertisements, Travolaa will invoice the Advertiser on receipt of their order. Payment must be made 30 days of the date of the invoice, after which interest will be payable on any amount outstanding at the rate of 2% per month until payment is made. If no payment is received, the advert will be withdrawn from the website.
Travolaa offers some of its one year advertising packages on payments options. This allows the Advertiser the opportunity to pay the total due (including VAT) in 12 monthly payments. If this option is taken then a direct debit/standing order will be required.
Travolaa may ask the Advertiser to pay in advance prior to the publication if the Advertiser has failed to pay any invoice in full by the due date on any past orders.
Travolaa reserves the right to refuse, amend or withdraw any adverts submitted at their discretion and without explanation. All adverts must comply with the British Code of Advertising Practice and must not be in breach of any relevant legislation, including the Race Relations Act 1976, the Sex Discrimination Act 1976 (both as amended), the Disability Discrimination Act 1995, the Employment Equality (Age) Regulations 2006 and the Obscene Publications Act and also including any legislation or regulation, such as those relating to the provision of Financial Services, which apply to specific Advertisers, products or services.
We also reserve the right to change format and/or design and/or content and/or name/domain name of the Website at any time.
In all circumstances outlined above, no refund of monies paid to us will be made and in submitting your advertisement for inclusion in the Website, you agree to these terms and conditions.
Travolaa will not be liable for any loss or damage consequential or otherwise occasioned by error, late publication or the failure of an advert to appear from any cause whatsoever. The total liability of Travolaa to the Advertiser for any act or omission of Travolaa, its servants or agents relating to any advertisement shall not exceed the amount of a full refund of any price paid to Travolaa for the advertisement.
The Advertiser shall supply Travolaa whenever appropriate such materials or inserts as may be required by us to publish an advert. Such materials must be of a quality suitable for our use and must be delivered to a specific location in sufficient time to suit our production requirements.
The Advertiser will indemnify and hold harmless Travolaa from and against any claim that the advertisement infringes the copyright, trademark or other intellectual property rights of any person or that it is defamatory or infringes any other right of any person. Travolaa reserves the right to withdraw and/or refuse to publish an advertisement without liability to the Advertiser if it reasonably believes that the advertisement may make Travolaa or the Advertiser liable to any complaint, claim or proceedings.
The liability of Travolaa is limited to placing advertisement approved by the Advertiser on the website maintained by Travolaa. Travolaa will endeavour to ensure that the advertisement is available at all times for viewing on its website but cannot be held responsible for failures of the internet or the server on which Travolaa’s website is located. Travolaa cannot be held responsible nor pay compensation for consequential losses or damages arising as above. Should the failure be prolonged Travolaa will do everything in its power to find an alternative provider and may offer at its discretion extended advertising periods.
If the Advertiser decides to cancel their advertising space for any reason, no refund will be made. Travolaa reserves the right to delete any listing without reason and without refund where either our own terms and conditions have been broken or where any illegal, racist or immoral act has been, or could be, committed.
All contracts are subject to the laws of England and any disputes should be settled by the courts under the English laws. The parties may agree in writing to submit their dispute to arbitration, in which case such arbitration shall be binding.
Comprehensive and detailed brand usage guidelines have been drawn up to govern all brand usage both internally and by third parties. These guidelines must be followed at all times.
